After the Drvar Municipality, by an official act of June 27th 2019., for the second time refused to issue parish of St. Joseph in Drvar, location permit for the reconstruction and extension of the multipurpose building, not respecting the second-degree solution of the Ministry of Construction, Reconstruction, Physical Planning and Environmental Protection of County of Hercegbosna, which had previously acknowledged the appeal of the Parish of Drvar at all points, an appeal from the parish has been made on this matter again on July 15th.

The appeal has been written on six pages and it proves again that the Municipality of Drvar did not respect the second-degree decision of the Ministry of Construction and all their instructions, and that the new denial is a new evidence of the free will and incoherence of the municipal authority in Drvar that illegally leads this administrative proceeding and brings unlawful and unacceptable solutions.

So the Ministry does not return this procedure to the first degree body, ie. the Drvar Municipality, which – as instructed in previous experience – would not have act differently after ten appeals, the Parish Drvar in this new appeal requests from the Ministry of Construction, as higher body, that it issues a decision to issue a location permit for the reconstruction and upgrading of an existing parish property. This request is justified in accordance with the regulations and provisions of the Law on Administrative Procedure, where Article 239, paragraph 1 explicitly states: “If the second-degree body finds that, on the basis of the facts established in the completed procedure the matter must be resolved differently than it has been resolved by the first-degree solution, it will with its decision cancel the first-degree solution and solve the matter on its own”.
